SUBSTITUTED TRUSTEE'S NOTICE OF SALE WHEREAS, on March 31, 2009, Philip W. Shaw, Jr. also known as Philip W. Shaw and Betty H. Shaw executed a Deed of Trust to Joy Lambert Phillips, Trustee, for the benefit of Hancock Bank, which Deed of Trust is filed for record as Instrument No. 2009 5551T-J1 in the office of the Chancery Clerk of Harrison County, at Gulfport, Mississippi, and which Deed of Trust was modified by Modification of Deed of Trust filed for record as Instrument No. 2010 6193T-J1 in the office of the aforesaid Chancery Clerk (collectively, the "Deed of Trust"); and WHEREAS, the Deed of Trust authorized the appointment and substitution of another Trustee in the place of the Trustee named in the Deed of Trust or subsequently substituted therein, and Whitney Bank, a Mississippi state chartered bank, formerly known as Hancock Bank, a Mississippi state chartered bank, appointed and substituted Mark T. Davis as Trustee therein, by instrument dated November 12, 2015, and duly filed for record in the office of the aforesaid Chancery Clerk as Instrument No. 2015 10368T-J1; and WHEREAS, default having been made in the performance of the terms and conditions of the Deed of Trust, and the entire indebtedness secured thereby having been declared to be due and payable pursuant to the terms of the Deed of Trust, and Whitney Bank, a Mississippi state chartered bank, formerly known as Hancock Bank, a Mississippi state chartered bank, the holder of the Deed of Trust and the related loan, having requested the undersigned Substituted Trustee so to do, I will, on the 31st day of August, 2017, offer for sale at public outcry and sell during legal hours, being between the hours of 11:00 a.m. and 4:00 p.m., at the main east door of the County Courthouse of the First Judicial District of Harrison County, at Gulfport, Mississippi, to the highest and best bidder, for same day payment by wire transfer of good funds, the following described land and property lying and being situated in the First Judicial District of Harrison County, Mississippi, and being more particularly described as follows, to-wit: Lots Twenty-nine (29), Thirty (30), Thirty-one (31) and the South 20 feet of Lot Thirty-two (32), Block Eight (8), GARY'S EAST SIDE ADDITION, a subdivision according to the official map or plat thereof on file and of record in the Office of the Chancery Clerk of the First Judicial District of Harrison County, Mississippi, in Plat Book 3 at Page 24 (Copy Book 1A at Page 71) thereof, reference to which is hereby made in aid of and as a part of this description. Foreclosure will be made subject to that certain deed of trust recorded in Book 2648 at Page 296 as Instrument No. 2003 11035T and assigned in Instrument No. 2013 1479T-J.1 I will convey only such title as is vested in me as Substituted Trustee.
