STATE OF MISSISSIPPI COUNTY OF HANCOCK SUBSTITUTE TRUSTEE'S NOTICE OF SALE WHEREAS, SouthTrust Bank ("SouthTrust") made a loan to Borrower, in the original principal amount of SEVEN HUNDRED FIFTY FIVE THOUSAND AND 00/100 Dollars ($755,000.00), evidenced by that certain Promissory Note dated May 28, 2002 ("Original Note"). Said Original Note was renewed by Wachovia Bank, ("Original Lender") successor by merger to SouthTrust, as evidenced by a certain Promissory Note, dated May 9, 2007, in the original principal amount of SIX HUNDRED TWENTY ONE THOUSAND NINE HUNDRED NINETEEN AND 86/100 Dollars ($621,919.86), with a maturity date of May 28, 2008 (collectively the "Notes"); and Borrower executed and delivered to SouthTrust, a Deed of Trust, dated May 28, 2002, and recorded June 3, 2002, in Book 695, Page 803, with the Chancery Clerk of Hancock County, Mississippi (the "Original Deed of Trust") encumbering certain real property and improvements located at 2430 McLaurin Avenue, Waveland, Mississippi 39 576-2655 , as more particularly described hereinafter (the "Real Property"). Said Original Deed of Trust was modified by an Amended and Restated Deed of Trust and Assignment of Rents from Borrower to Original Lender, dated May 9, 2007, and recorded in Book 2007, Page 27881, with the Chancery Clerk of Hancock County, Mississippi, ("Amended Deed of Trust") encumbering the Real Property (collectively the "Deeds of Trust"); On or about December 21, 2007, Wachovia Bank, National Association, successor by merger to SouthTrust sold, assigned and transferred all of its right, title and interest in and to the Original Deed of Trust, Amended Deed of Trust, and Original Loan Documents, to RCH Mortgage Fund IV, LLC ("RCH IV"), by Assignment of Note, Deed of Trust and Loan Documents recorded January 31, 2008, in Book 2008, Page 3963, with the Clerk of the Chancery Court of Hancock County, Mississippi; The Original Deed of Trust was further assigned as follows, all recorded with the Chancery Clerk of Hancock County, Mississippi: (i) Collateral Assignment of Deed of Trust from RCH Mortgage Fund IV, LLC, to Wells Fargo Foothill, LLC, recorded March 5, 2009, in Book 2009, Page 6187; (ii) Reassignment of Collateral Assignment of Deed of Trust from Wells Fargo Capital Finance, LLC, formerly known as Wells Fargo Foothill, LLC to RCH Mortgage Fund IV, LLC, recorded February 25, 2013, in Book 2013, Page 4366; (iii) Assignment of Mortgage and Other Loan Documents from RCH Mortgage Fund IV, LLC, to RCH Mortgage Fund IV-A, LLC, recorded February 11, 2013, in Book 2013, Page 3243 and re-recorded February 25, 2013, in Book 2013, Page 4369; (iv) Assignment of Mortgage and Other Loan Documents from RCH Mortgage Fund IVA, LLC to RCH IV Mortgage Trust, recorded February 25, 2013, in Book 2013, Page 4377; (v) Assignment of Deed of Trust and Other Loan Documents from RCH IV Mortgage Trust to RCH Mortgage Fund IV, LLC, recorded December 8, 2014, in Book 2014, Page 22092; (vi) Assignment of Deed of Trust and Other Loan Documents from RCH Mortgage Fund IV, LLC to Lender, recorded January 14, 2016, in Book 2016, Page 698. WHEREAS, at the time of execution of said Deed of Trust the beneficiary appointed TRSTE, Inc., a Virginia Corporation, as Trustee; and WHEREAS, on the 16th day of November, 2016, the Holder of said Deed of Trust, RCH Mortgage Fund V, LLC, substituted and appointed Michael J. Yentzen as Trustee in said Deed of Trust, by instrument recorded in Book 2016, Page 25076, recorded on November 21, 2016, in the office of the Chancery Clerk of Hancock County, Mississippi; and WHEREAS, default having been made in the payments of the indebtedness secured by said Deed of Trust, and the holder of said Deed of Trust, RCH Mortgage Fund V, LLC, having requested the undersigned to do so, on the 30th day of August, 2017, I will during the lawful hours of between 11:00 a.m. and 4:00 p.m., at public outcry, offer for sale and will sell, at the North Door of the Courthouse of Hancock County, Mississippi, 152 Main Street, Bay St. Louis, Mississippi 39520, for cash to the highest bidder, the following described land and property situated in Hancock County, Mississippi, to-wit: "Beginning for survey at an iron pin located at the intersection of the North right-ofway of the U.S. # 90 Highway and the western line of McLaurin Street in the extended city limits of Waveland, Mississippi. Said point being located South 4 degrees 55 minutes West from the original monument at the NE corner of Section 34 in Township 8 South, Range 14 West; thence go North 4 degrees 55 minutes East along the West line of McLaurin Street for a distance of 105 feet to iron pin and true point of beginning; thence South 68 degrees 29 minutes west and parallel and adjacent to the North line of ingress and egress to Choctaw Plaza shopping area and McDonald's restaurant for a distance of 117 feet to iron pin; thence North 21 degrees 31 minutes West and along McDonald's Restaurant property for a distance of 200 feet to iron pin; thence north 68 degrees 29 minutes East for 217 feet to iron pin on the western right-of-way line of McLaurin Street to iron pin; thence South 4 degrees 55 minutes west along the west line of McLaurin Street for a distance of 224 feet to iron pin and point of beginning. Said property being located on the west line of McLaurin Street in the extended city limits of Waveland, Mississippi, in Hancock County, Mississippi, and being a part of the South Half of Government Lot One of the original division of fractional Section 34, Township 8 South, Range 14 West, Hancock County, Mississippi."
