NOTICE OF SUBSTITUTE TRUSTEE'S SALE STATE OF MISSISSIPPI COUNTY OF JACKSON WHEREAS, on November 13, 2012, CALVIN BROOKS and wife, DEBORAH KAYE BROOKS, executed a Deed of Trust to Michael L. Fondren, Trustee for NAVIGATOR CREDIT UNION, Beneficiary, which is recorded in Book 3086 at Page 134 (Instrument # 201219116) in the Office of the Chancery Clerk of Jackson County, Mississippi; and WHEREAS, said Deed of Trust was modified by Loan Modification Agreement dated July 24, 2015, and recorded in Book 3295 at Page 598 (Instrument # 201511550) in the aforesaid office; and WHEREAS, NAVIGATOR CREDIT UNION appointed Gerald M. Warren as Substitute Trustee by instrument dated December 13,2018, and recorded in Book 3558 at Page 235 (Instrument # 201825531) in the aforesaid office; and WHEREAS, the legal description in the Deed of Trust was corrected by an Affidavit of Scriveners=s Error dated January 15, 2019, recorded in Book 3562 at Page 5 (Instrument # 201901130) in the aforesaid office; and WHEREAS, default having been made in the payment of the indebtedness secured by said Deed of Trust, which default has continued for a period of time necessary for the holder to declare the entire unpaid balance immediately due and payable, and NAVIGATOR CREDIT UNION, the holder of the Deed of Trust as aforesaid, having requested the undersigned Substitute Trustee so to do, I will on the 7th day of March, 2019, offer for sale at public outcry and sell during the legal hours, being between the hours of 11:00 o'clock a.m. and 4:00 o'clock p.m., at the West front door of the Jackson County Courthouse in Pascagoula, Mississippi, for cash or certified funds ONLY, to the highest and best bidder, the following described land and property lying and being situated in the County of Jackson, State of Mississippi, and more particularly described as follows, to-wit: Lot 36 of Rolling Hills Subdivision as per plat thereof recorded in Plat Book 18, Pages 35-37, on file in the Office of the Chancery Clerk of Jackson County, Mississippi. And being the same as that property described in Deed Book 939, Page 546, Land Deed Records of Jackson County, Mississippi. AND ALSO: Part of Lot 35 of Rolling Hills Subdivision, as per plat thereof recorded in Plat Book 18, Pages 35-37, on file in the Office of the Chancery Clerk of Jackson County, Mississippi, and more fully described as follows: Beginning at the Southeast corner of Lot 35, thence South 50 degrees 28 minutes 24 seconds West 54.18 feet; thence North 44 degrees 38 minutes 23 seconds West 615.39 feet to the South margin of Sierra Lane; thence Southeasterly along the South margin of Sierra Lane to the Northeast corner of Lot 35, said point being South 88 degrees 36 minutes 19 seconds East 77.23 feet from the previous point; thence South 47 degrees 22 minutes 02 seconds East 570.29 feet to the Point of Beginning. LESS AND EXCEPT that part of Lot 35 of Rolling Hills Subdivision previously conveyed to Robert A. Colgan and wife, Loretta M. Colgan, dated August 24, 1990, and recorded in Deed Book 963, Page 142-143, containing 3 acres, more or less. And being the same as that property described in Deed Book 963, Page 250 Land Deed Records of Jackson County, Mississippi. I will convey only such title as is vested in me as Substitute Trustee.
