STATE OF MISSISSIPPI COUNTY OF HARRISON SECOND JUDICIAL DISTRICT NOTICE OF TRUSTEE'S SALE WHEREAS, Chateau Le Grande Development Fund, a Mississippi Limited Partnership, platted Chateau Le Grand Condominiums as reflected in Plat Book 8 at Page 12 of the land deed records of Harrison County, Second Judicial District. WHEREAS, the Condominium and all Units are governed by the Condominium Declaration for Chateau Le Grand Condominiums as recorded in Book 102, pages 183-213, and as Amended in Book 112 at Pages 438-478, all in the Records of Deeds in the office of the Chancery Clerk of the Second Judicial District, Harrison County, Mississippi, which provides that each condominium unit and unit week in the case of a timeshare unit shall be subject to an annual maintenance charge. The Declaration further provides that a lien in favor of Chateau Le Grand Property Owners Association aka Chateau Le Grande Property Owners Association ("the Association") is granted against the Units and Unit Weeks in the event of non-payment to secure the payment of the maintenance. WHEREAS, default has occurred in the payment of maintenance fund charges assessed by the Association against James A. Harris, Jr., owner of Unit No. 401, Living Unit 410A, Week 35; and the Association has caused to be filed a Notice of Condominium Lien against the said owner and unit, dated the 3rd day of October, 2019, and being recorded as Instrument No. 2019-17274G-J2 in the records of Condominium Liens in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi. WHEREAS, the Association is authorized and empowered pursuant to Section 89-9-21 of Miss. Code Ann. (1972) to enforce its lien by sale by the Association after failure of the owners to pay such assessments and that such sale shall be conducted in accordance with the provisions of Section 89-1-55 Miss. Code Ann. (1972). WHEREAS, the Association did appoint David A. Wheeler as Trustee for the purpose of conducting the execution sale and foreclosure of the liens as herein provided, said Appointment of Trustee being dated the 27th day of November, 2019, and being recorded as Instrument No. 2019-3727T-J2 in the Land Records in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi. WHEREAS, default having been made in the payment of the aforementioned lien and the entire debt secured thereby having been disclosed and payable to said Owner and no payment having been received, the Association has requested the undersigned Trustee to execute the trust and sell said Unit and week in accordance with the appropriate terms and conditions of the Condominium Declaration and the amendments thereto and the appropriate statutes of the State of Mississippi and for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale. NOW THEREFORE, the undersigned Trustee, pursuant to such authority and the request so made does hereby give notice that he will sell during legal hours (between the hours of 11:00 a.m. and 4:00 p.m.) on the 6th day of February, 2020, at the South Front Door of the County Courthouse for the Second Judicial District of Harrison County, at Biloxi, Mississippi, in accordance with the appropriate terms and conditions of the Condominium Declaration and the amendments thereto and the laws of the State of Mississippi, for cash, the real property being situated in the Second Judicial District of Harrison County, Mississippi, and being more particularly described as follows, to-wit: Unit No. 401, CHATEAU LEGRANDE CONDOMINIUMS, for the 35th Unit Week of each year, as defined in Article 1, Section 8 of the Amended Declaration of Covenants, Conditions, and Restrictions of Chateau Le Grande Condominiums, as appears of recorded in Deed Book 112 at Pages 438-478, in the Office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi, together with an undivided 1/2500 interest in the common areas appurtenant thereto, as provided in the Declaration of Covenants, Conditions and Restrictions of Chateau LeGrande Condominiums, dated June 4, 1980, recorded in Book 102, at Pages 183, et. seq., as amended August 17, 1981, recorded in Book 112, at Pages 438-478, of the Land Deed Records of the Second Judicial District of Harrison County, Mississippi, according to the plat thereof, as recorded in Plat Book 8, at Pages 12-17, in the office of the Chancery Clerk of the Second Judicial District of Harrison County, Mississippi, at Biloxi, Mississippi, said unit also being known as Living Unit 410A.
