STATE OF MISSISSIPPI COUNTY OF HARRISON FIRST JUDICIAL DISTRICT SUBSTITUTED TRUSTEE'S NOTICE OF SALE WHEREAS, on August 11, 2003, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to LYLE M. PAGE, as Trustee for the benefit of THE PEOPLES BANK BILOXI MISSISSIPPI, Beneficiary, which Deed of Trust is recorded in Book 2719 at Page 343, which was renewed and extended as set forth herein and which was modified by Modification Agreement recorded as Instrument No. 2014 3552 T-J1, extending the maturity date thereof. WHEREAS, on August 11, 2003, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to LYLE M. PAGE, as Trustee for the benefit of THE PEOPLES BANK BILOXI MISSISSIPPI, Beneficiary, which Deed of Trust is recorded in Book 2719 at Page 527; and WHEREAS, on August 19, 2005, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to LYLE M. PAGE, as Trustee for the benefit of THE PEOPLES BANK BILOXI MISSISSIPPI, Beneficiary, which Deed of Trust as Instrument No. 2005 37103T-J1, which is a renewal and extension of Deed of Trust recorded in Book 2719 at Page 343, and all of the foregoing referenced instruments. WHEREAS, on August 6, 2007, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to LYLE M. PAGE, as Trustee for the benefit of THE PEOPLES BANK BILOXI MISSISSIPPI, Beneficiary, which Deed of Trust is recorded as Instrument No. 2007 16717T-J1. Said instrument is a renewal and extension of that Deed of Trust recorded as Instrument No. 2005-37103T-J1, and all of the foregoing referenced instruments; and WHEREAS, on December 15, 2009, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to LYLE M. PAGE, as Trustee for the benefit of THE PEOPLES BANK BILOXI MISSISSIPPI, Beneficiary, which Deed of Trust is recorded as Instrument No. 2010 1307T-J1. Said instrument is a renewal and extension of Instrument No. 2007 16717T-J1, and all of the foregoing referenced instruments recorded in the office of the Chancery Clerk of Harrison County, First Judicial District, Mississippi; and WHEREAS, on September 30, 2016, MAUFFRAY HOLDINGS, LLC, executed a Deed of Trust to DAVID M. ALLEN, as Trustee for the benefit of THE PEOPLES BANK, BILOXI, MISSISSIPPI, Beneficiary, which Deed of Trust is recorded as Instrument No. 2016 9439T-J1. Said instrument is a renewal and extension of that Modification Agreement recorded as Instrument No. 2014-3552T-J1, and all of the foregoing referenced instruments in the office of the Chancery Clerk of Harrison County, First Judicial District, Mississippi; and WHEREAS, THE PEOPLES BANK BILOXI MISSISSIPPI, substituted ROBERT T. SCHWARTZ of Biloxi, Mississippi, in the place and stead of the said LYLE M. PAGE AND DAVID M. ALLEN named as Trustees in the above described Deeds of Trust, which Substitution of Trustee is recorded in the office of the aforesaid Chancery Clerk as Instrument 2018-10078-T-J1; and WHEREAS, default having been made in the terms and conditions of said Deeds of Trust and the entire debts secured thereby, having been declared to be due and payable in accordance with the terms of said Deeds of Trust, and the legal holder of said indebtedness, THE PEOPLES BANK BILOXI MISSISSIPPI, having requested the undersigned Substituted Trustee to execute the trusts and sell said land and property in accordance with the terms of said Deeds of Trust for the purpose of raising the sums due thereunder, together with attorney's fees, trustee's fees and expenses of sale; NOW, THEREFORE, I, ROBERT T. SCHWARTZ, Substituted Trustee in said Deeds of Trust, will on the 8th of March, 2019, offer for sale and will sell at public outcry, to the highest bidder for cash, within the legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the east front door of the County Courthouse at Gulfport, Harrison County, First Judicial District, State of Mississippi, the following described property situated and lying in the County of Harrison, First Judicial District, State of Mississippi, to- wit: Parcel I: A certain parcel of land located in and a part of Block 9 and 19, Gulf and Ship Island Development Company Subdivision, Section 4, Township 7 South, Range 11 West, Harrison County, Mississippi, being described as follows, to- wit: Commencing at a point where the Western right-of-way line of U.S. Highway 49 intersects the Northern boundary of Lot 24, Block 10, Gulf & Ship Island Development Company Subdivision, running thence South 07 degrees 45 minutes 19 seconds East along the West margin of said U.S. Highway 49 a distance of 204.30 feet to the Point of Beginning. From said Point of Beginning, running thence South 89 degrees 38 minutes 19 seconds West a distance of 320.85 feet to a point between Lots 36 and 37, Block 9 of said Subdivision; running thence South 00 degrees 04 minutes 30 seconds East along the common boundary of Lots 36 and 37 and Lots 12 and 13 of said Subdivision a distance of 207.40 feet to a point which is on the North margin of 13th Street and is the Southeast corner of Lot 12, Block 9; running thence North 89 degrees 38 minutes 19 seconds East along the North margin of 13th Street a distance of 348.80 feet to the West right-of-way line of U.S. Highway 49; running thence North 07 degrees 45 minutes 19 seconds West along the West margin of said U.S. Highway 49 a distance of 209.14 feet to the Point of Beginning, being situated in the First Judicial District of Harrison County, Mississippi. Parcel II: Beginning at the Southeast corner of Lot 12, Block 9, Gulf and Ship Island Development Company Subdivision and running thence South 89 degrees 38 minutes 19 seconds West along the North margin of 13th Street for a distance of 300.00 feet to a point being the Southwest corner of Lot 1, Block 9 of said Subdivision; running thence North 00 degrees 04 minutes 30 seconds West on and along the East boundary of what was formerly known as Railroad Avenue prior to its vacation for a distance of 207.40 feet to a point; running thence North 89 degrees 38 minutes 19 seconds East parallel with 13th Street for a distance of 300.0 feet to a point; running thence South 00 degrees 04 minutes 30 seconds East on and along the line dividing Lots 36 and 37 and Lots 12 and 13 of Block 9 of said Subdivision for a distance of 207.40 feet back to the Point of Beginning. All being located in Section 4, Township 7 South, Range 11 West, First Judicial District of Harrison County, Mississippi. ALSO an easement for ingress over and across all that part of what was formerly known as Railroad Avenue prior to its vacation lying and being West of and adjacent to the above described real property with said right-of-way having an East-West width of 35 feet, more or less, and a North-South length of 207.4 feet, more or less.
